no decision shall be rendered by any court of record without stating clearly and
distinctly the law and the facts on which it is based
Held:
No. Section 12 (now section 14),
Article VIII of the Constitution refers only to decisions of the merit and not to
orders of the trial court resolving incidental matters such as the one at bar.
